Contract Terms

These sections are written to be generic and editable. Photographers should tweak to match their business model.

Entire Agreement. This agreement contains the entire understanding between the Photographer and the Client and supersedes all prior discussions or agreements. Any modifications must be made in writing and agreed upon by all parties.

Reservation & Payment. The session/event date and time are reserved upon execution of this agreement. A retainer may be required to hold the date and is non-refundable unless otherwise stated by the Photographer. The remaining balance is due on or before the date stated above, unless otherwise agreed upon in writing.

Client Cooperation. The Client agrees to arrive on time and prepared. The Photographer is not responsible for missed images due to lateness, uncooperative subjects, weather conditions, venue restrictions, or circumstances beyond the Photographer’s control.

Copyright & Image Use. All images remain the copyrighted property of the Photographer. The Client is granted personal print and sharing rights only. Images may not be altered, sold, or used commercially without written permission from the Photographer.

Editing & Delivery. The Photographer will provide preview images and final gallery delivery based on the turnaround times listed above. Turnaround may vary during peak seasons or due to unforeseen circumstances.

Limit of Liability. In the unlikely event of equipment failure, loss of images, illness, acts of God, or other unforeseen circumstances, the Photographer’s liability shall be limited to the return of payments received.

Model Release. Client grants permission for portfolio/marketing use unless requested otherwise in writing.

Event Photography Safeguards (if applicable). For events, the Client understands timing and coordination are essential. The Client agrees to provide an event timeline and a point person for gathering groups. If a severe emergency prevents the Photographer from attending, the Photographer may attempt to secure a replacement photographer; if no replacement is available, liability is limited to refund of payments received.
